I-360 Processing
Form I-360 is used to classify an alien as an Amerasian, Widow(er), or as a Special Immigrant. This petition is usually filed at a USCIS Office in the United States. Form I-360 categories and filing requirements follow:

Self-Petitioning Spouse or Child of an Abusive U.S. Citizen: File at the Vermont Service Center

Special Immigrant - Religious Worker: File at the Service Center with jurisdiction over the state where you will be residing.

Widow(er): File with your I-485 at the local Office with jurisdiction over your place of residence; if you are filing without an I-485, file the petition at the Service Center with jurisdiction over your state of residence; if you are outside the U.S., and are filing without an I-485, file at the Foreign Office with jurisdiction over your place of residence.

Special Immigrant - Military: If you are filing with an I-485, and are in the U.S., file at the local Office with jurisdiction over your place of residence; if you are filing without an I-485, and are in the U.S., file at the Service Center with jurisdiction over your place of residence; if you are filing without an I-485 and are outside the U.S., file at the Foreign Office with jurisdiction over your place of residence.

Special Immigrant - Juvenile: File your petition with the local office with jurisdiction over your place of residence.

Amerasian: If you are living in the U.S., file your petition with the local Office with jurisdiction over your place of residence; if you are living outside of the U.S., you can either file your petition with the Foreign Office that has jurisdiction over your current place of residence, or you can file your petition with the local Office that has jurisdiction over your intended place of residence in the U.S.

Special Immigrant - Physician: File your petition with the Service Center with jurisdiction over your place of residence

Special Immigrant - Panama canal: File your petition with the Service Center with jurisdiction over your place of residence.

Special Immigrant-International Organization Officer or Employee and Family Members: Use the addresses listed below when mailing Form I-360 and associated forms and correct fees, to USCIS. Please note that there is a different address if you are filing only Form I-360, if you are filing it concurrently with Form I-485 or if a Special Immigrant International Organization Officer or Employee and Family Members I-360 has been previously approved.

We have jurisdiction over the adjudication of Form I-360 under the following categories:
– The widow or widower of a U.S. citizen. The form allows such person to petition for himself or herself, and to petition for his or her child. The widow or widower of an LPR cannot self-petition. Likewise, the child of a deceased citizen cannot self-petition; the child must be included in his or her parent’s widow/widower self-petition.
– Special Immigrant Military Petitions
– Amerasian under Public Law 97-359, as amended by subsequent legislation.
Qualified Applicants may file their petitions between 9:00 AM and 12:00 Noon on all normal business days.
The appropriate fee must be paid through the Consular section’s cashier once our office has requested payment of the fee. Normally, this is at the conclusion of your interview in our offices. The fee may be paid in cash in U.S. or Indian currency. One receipt showing proof of payment must be returned to our offices. Please contact the Consular Cashier if you have further questions.
